These Terms of Use (“Terms”) form a binding agreement between you and Penweet, the operator of penweet.com and related services (collectively, “Penweet”, “we”, “us”, or “our”). They govern your access to and use of our creative community platform for designers and agencies, including profiles, portfolios, stories, teams, messaging, jobs, follows, blocks, reports, and related features (the “Service”). By creating an account, clicking accept, or using the Service, you agree to these Terms and our Privacy Policy and Cookies Policy. If you do not agree, do not use the Service.
1. Definitions
“User Content” means any content you submit, upload, publish, or transmit through the Service, including portfolio projects, images, videos, text, stories, comments, messages, profile information, team materials, job applications, and reports. “Agency Account” means an account registered for a studio, agency, or organization. “Penweet ID” means your unique public username on the Service.
2. Eligibility and capacity
You must be at least 18 years old and legally able to enter a binding contract under the laws applicable to you. The Service is intended for professional creative networking and employment discovery; accounts for minors are not permitted. If you open an Agency Account, you represent that you are authorized to bind that organization to these Terms, and “you” includes that organization.
- You must provide accurate, complete, and current registration information (including name, email, date of birth where collected, country, and Penweet ID).
- You may not create an account using false identity, impersonation, or another person’s credentials.
- One person or organization should control an account; sharing login credentials is prohibited.
3. Accounts, security, and verification
You are responsible for safeguarding your password, OAuth-linked accounts, session devices, and all activity under your account. Email verification may be required before certain features (uploads, messaging, jobs, teams) are available.
- Notify us immediately at support@penweet.com if you suspect unauthorized access, credential theft, or account compromise.
- We may require re-authentication, revoke sessions, reset credentials, or suspend accounts to protect security.
- You may terminate other sessions from Settings where that feature is available.
- We may reclaim, rename, or restrict Penweet IDs that are misleading, infringing, reserved, abusive, or needed for platform integrity.
4. The Service
Penweet provides tools for creatives and agencies to build profiles; upload and organize portfolio work; publish time-limited stories; discover inspiration and design tricks; follow users; like, comment on, share, or view posts; join or create teams (public or private); exchange messages subject to privacy settings; block or report users; explore freelance and full-time design opportunities; and manage account, privacy, and notification preferences. Features may change, be limited by region, or be discontinued as we improve the product. We do not currently process payments inside the Service unless we expressly introduce paid features under separate terms.
5. Your content — ownership and license
You retain all ownership rights in your User Content to the extent you own them under applicable law. Penweet does not claim ownership of your creative work.
- License to Penweet: By submitting User Content, you grant Penweet a worldwide, non-exclusive, royalty-free, transferable (only to successors or service operators), sublicensable (only to hosting, CDN, email, and infrastructure providers as needed) license to host, store, reproduce, process, adapt for technical display (e.g., resize, transcode, crop thumbnails), publicly display, publicly perform, distribute, and communicate your User Content solely to operate, secure, improve, and promote the Service, including showing work in Discover, search, feeds, team pages, profiles, emails, and marketing that features platform examples with attribution where reasonably practical.
- License duration: The license ends when your User Content is deleted from our active systems, except for (a) reasonable backup and disaster-recovery copies that are deleted or overwritten on a rolling schedule, (b) content retained as required by law or for security, fraud, dispute, or abuse investigations, and (c) content that other users have lawfully reshared, cached, or downloaded before deletion (which we cannot fully control).
- No sale of your IP: We do not sell your User Content. We do not use your portfolio or creative User Content to train generative AI foundation models for third parties. If that practice ever changes, we will update these Terms and obtain any consent required by applicable law before doing so.
- Your warranties: You represent that you own or have all rights, licenses, consents, and permissions needed to upload and share User Content; that it does not infringe intellectual property, privacy, publicity, or other rights; that it complies with these Terms and law; and that any people depicted have consented where required.
- Feedback: Suggestions or feedback you send about Penweet may be used by us without obligation to you.
6. Intellectual property of Penweet
The Service software, design system, trademarks, logos, and non-user materials are owned by Penweet or its licensors. Except for the limited rights needed to use the Service, no license is granted to copy, reverse engineer (except where mandatory law permits), scrape at scale, mirror, or commercially exploit Penweet’s platform, brand, or non-public interfaces without prior written permission.
7. Copyright and rights complaints
If you believe User Content infringes your copyright or other IP rights, send a notice to privacy@penweet.com and support@penweet.com including: (1) your contact details, (2) identification of the protected work, (3) the URL or location of the allegedly infringing material, (4) a statement of good-faith belief that use is unauthorized, and (5) a statement that the information is accurate and that you are the rights holder or authorized agent. We may remove or disable access to material, notify the uploader, and suspend repeat infringers where appropriate. Counter-notices may be submitted with comparable detail if content was removed in error.
8. Acceptable use
You agree to use the Service lawfully, professionally, and respectfully. Without limitation, you must not:
- Upload or share illegal, fraudulent, deceptive, defamatory, harassing, hateful, sexually exploitative, or violently graphic content, or content involving minors in any sexual or exploitative context.
- Impersonate others, misrepresent affiliations, or manipulate portfolios, credentials, awards, or job applications.
- Harass, stalk, threaten, dox, or blackmail users; misuse messaging, Hire Us, follows, comments, or team invitations for spam, phishing, or mass unsolicited commercial messages.
- Upload malware, attempt unauthorized access, probe vulnerabilities outside a coordinated disclosure program, bypass rate limits, forge requests, or interfere with Service integrity.
- Scrape, harvest, or bulk-export personal data or portfolio assets through automated means without our prior written consent, except ordinary browser use or public search-engine indexing of publicly available pages as allowed by robots.txt.
- Circumvent privacy, block, or visibility controls; open multiple accounts to evade enforcement; abuse reports; or encourage others to violate these Terms.
- Use the Service to facilitate employment discrimination that is unlawful in the applicable jurisdiction, or to post jobs that are fake, bait-and-switch, or collect applicant data for unrelated purposes.
- Violate export, sanctions, or other applicable regulatory restrictions.
9. Visibility, messaging, teams, and stories
Profile, portfolio, and project visibility follow the settings and product defaults you choose (for example everyone, followers, or only you). Stories are designed to expire after approximately 24 hours from publication, subject to technical delays and moderation holds. Messaging is subject to each user’s can-message preference (e.g., anyone or following only), blocks, and our abuse controls. Online-status visibility may be limited to everyone or followers only where that setting is available. Teams may be public or private; invitations and join requests must be used in good faith. Private team materials must not be redistributed outside authorized members without permission from the rights holder.
10. Jobs and opportunities
Job and freelance listings are provided for discovery. Penweet is a venue, not an employer, recruiter of record, or party to hiring agreements between users and employers, unless separately agreed in writing. We do not guarantee interviews, offers, compensation, or outcomes. Employers and applicants are solely responsible for the accuracy of listings and applications, lawful hiring practices, and any offline contracts. Application data you submit may be shared with the listing party as needed to process the application.
11. Moderation, suspension, and termination
We may remove or restrict User Content, limit features, require verification, suspend, or terminate accounts that violate these Terms, create legal or security risk, or harm the community—with or without prior notice where urgency requires. You may delete your account from Settings; deletion follows the process described in the Privacy Policy (including anonymization and soft-deletion practices). Provisions that by nature should survive (IP licenses for residual copies, disclaimers, liability limits, indemnity, governing law) survive termination.
12. Third-party services
Optional sign-in with Google or Facebook, external job apply links, embedded media, and other third-party services are governed by those providers’ terms and privacy policies. Penweet is not responsible for third-party sites or their processing. Enabling OAuth constitutes your instruction to receive limited identity data from that provider as described in our Privacy Policy.
13. Disclaimers
THE SERVICE IS PROVIDED ON AN “AS IS” AND “AS AVAILABLE” BASIS. TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, WE DISCLAIM ALL WARRANTIES NOT EXPRESSLY STATED IN THESE TERMS, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. We do not warrant uninterrupted, error-free, or fully secure operation, nor the quality, legality, or availability of User Content or job listings.
14. Limitation of liability
TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, PENWEET AND ITS DIRECTORS, OFFICERS, EMPLOYEES, AND AGENTS SHALL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR FOR LOSS OF PROFITS, REVENUE, DATA, GOODWILL, OR BUSINESS OPPORTUNITY, ARISING FROM OR RELATED TO THE SERVICE OR THESE TERMS, WHETHER BASED IN CONTRACT, TORT, OR OTHERWISE. OUR AGGREGATE LIABILITY FOR ALL CLAIMS RELATING TO THE SERVICE IN ANY TWELVE-MONTH PERIOD SHALL NOT EXCEED THE GREATER OF (A) THE AMOUNTS YOU PAID TO PENWEET FOR THE SERVICE IN THAT PERIOD, OR (B) ONE HUNDRED US DOLLARS (USD 100) OR ITS EQUIVALENT. NOTHING IN THESE TERMS EXCLUDES LIABILITY THAT CANNOT BE EXCLUDED UNDER MANDATORY LAW (INCLUDING LIABILITY FOR DEATH OR PERSONAL INJURY CAUSED BY NEGLIGENCE, OR FOR FRAUD).
15. Indemnity
You will defend, indemnify, and hold harmless Penweet and its personnel from and against claims, damages, losses, and expenses (including reasonable legal fees) arising out of your User Content, your use of the Service, your violation of these Terms or law, or your infringement of third-party rights—except to the extent caused by Penweet’s willful misconduct.
16. Changes to the Terms
We may update these Terms as the Service evolves. The “Last updated” date will change when we do. Material changes will be communicated by reasonable means (for example, email to the address on your account, in-product notice, or a banner). Continued use after the effective date constitutes acceptance, except where mandatory law requires a different consent mechanism. If you do not agree, stop using the Service and delete your account.
17. Governing law and disputes
These Terms are governed by the laws of the Kingdom of Saudi Arabia, without regard to conflict-of-law rules that would require another jurisdiction’s laws. Courts of competent jurisdiction in the Kingdom of Saudi Arabia shall have exclusive jurisdiction, subject to any mandatory consumer protections that cannot be waived in your country of residence. You and Penweet will first attempt in good faith to resolve disputes by contacting support@penweet.com.
18. General
If any provision is held unenforceable, the remainder remains in effect. Failure to enforce a provision is not a waiver. You may not assign these Terms without our consent; we may assign them in connection with a reorganization, merger, or sale of assets. These Terms, together with the Privacy Policy and Cookies Policy, are the entire agreement regarding the Service and supersede prior conflicting statements about the same subject. Headings are for convenience only.
